Holland America Line Cruise Certificate Raffle Rules and Regulations

North Coast Community Homes (NCCH), a tax exempt organization under Section 501(c)(3) of the Internal Revenue Code, is conducting this raffle in accordance with Ohio law, to raise funds for ongoing charitable purposes. The Rules and Regulations of the raffle are set forth below.

By purchasing a raffle ticket the purchaser agrees to be bound by these rules and regulations. NCCH’s interpretation and application of the Rules and Regulations shall be final. The drawing for one Holland America Line Cruise Certificate will be conducted by NCCH on Monday, July 17, 2017 at 6:00 p.m. EST by NCCH ’s CEO and President or NCCH’s VP of Development. All tickets and monies must be in hand at NCCH by 7:00 a.m. EST on July 17, 2017 to be eligible. Any tickets or monies received after 7 a.m. on July 17, 2017 will not be eligible or refundable.

The drawing is open to the public, but the winner does not need to be present to win. The winner will be notified in writing, by email, or by telephone. All contact attempts shall be made to the address, email, and telephone number provided by the raffle ticket purchaser. 100% of the proceeds will go to support NCCH’s programs and services for adults with disabilities. The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently do not qualify as deductible charitable contributions. Participants should check federal and state tax treatment with their respective tax advisors. The winner of the Holland America Line Cruise Certificate assumes all fees, local, state and federal taxes (including but not limited to income taxes based on the value of the chosen cruise). NCCH takes no responsibility for any tax liabilities and we recommend consulting your tax advisor for any additional questions.

The Prize – Rules and Regulations

The prize is a Cruise Certificate valid for a Holland America Line cruise for two (2) people sharing one stateroom - the statement category will be, at a minimum, an ocean view stateroom selected by Holland America Line. Choice of sailing dates will be accommodated on a space available basis and will be confirmed at time of request. The Cruise Certificate may be applied to any number of days up to twelve (12). The Cruise Certificate may be applied to other cabin categories or cruise trades at an additional cost. Call World Cruise Reservations for details.

If space is available, stateroom upgrades may be purchased at an additional cost. Third and fourth persons are permitted in the same stateroom and will be charged the per person tariff per the applicable Holland America Line brochure and rules. Guests under 21 years of age must be accompanied by a parent, guardian or chaperone that is at least 21 years old.

The Cruise Certificate is for the cost of the cruise only. Costs of transportation to and from the port of embarkation, hotels, taxes, fuel supplement and surcharges as applicable, transfers, shore excursions, personal expenses on board (e.g., laundry, certain beverages, phone calls, etc.) and hotel service charges are NOT included. Holland America Line’s Cancellation Protection Plan, Cancellation Protection Plan Platinum, Fly Cruise Plan, overnight hotel accommodations, and Pre- and Post-cruise packages are available for purchase by Guests holding the Cruise Certificate. Cancellation of a cruise after the cruise has been confirmed will result in the forfeiture of the Cruise Certificate unless applicable voyage penalties are satisfied.

The Cruise Certificate is noncommissionable, non-refundable, has no cash redemption value and is non-transferable. Stateroom upgrades are commissionable. The Cruise Certificate cannot be re-sold. The original of the Cruise Certificate together with payment for taxes, fuel supplement and surcharges as applicable must be submitted to Holland America Line. No partial forms or photocopies will be accepted. The Certificate does not have an expiration date.

All Holland America Line cruises are provided subject to the terms of the Holland America Line Cruise Contract. Anyone 18 years of age or older legally residing in the State of Ohio or elsewhere as allowed by US an applicable state law may purchase a raffle ticket. NCCH, the office of development, accounting, and all employees at Headquarters, 14221 Broadway Ave, Cleveland, OH, the President & CEO, the Chief Financial Officer, and their spouses, children and anyone living in the same household are excluded from participating and are not eligible to win a prize. All federal, state, and local laws and regulations apply.


Tickets are $10.00 each or three tickets for $25.00. The tickets will have a detachable coupon or stub, and both the ticket and its associated coupon or stub will be marked with a unique and matching identifier. Tickets may be purchased through any participating NCCH location, via phone, by returning mailed tickets, or via online. Online ordering may be done here -

Entries must include payment by Cash, Check or Credit Card to be eligible. Ticket stubs showing confirmation number(s) will be mailed to all purchasers at the billing address provided during the purchase, if acquired by mail or telephone. Individuals may purchase an unlimited number of tickets. However, all sales transactions are final. No payments will be refunded. It is the ticket purchaser’s responsibility to provide a valid, deliverable mailing address to NCCH. NCCH and its agents, employees, board members, volunteers and staff assume no liability for lost, late, misdirected, mutilated, incomplete, illegible, undelivered entries or entries without proper payment received; and all such entries shall be deemed invalid and shall be immediately disqualified.

Only one eligible person may be entered in the raffle per ticket sold. If the name of more than one person is submitted with a ticket purchase, and that ticket is selected as a winning ticket, then the person named first will be deemed the holder of record of that ticket and declared the winner. Records of NCCH shall be deemed correct if there is any discrepancy. Division of the prize by a group purchasing a ticket in common shall be the sole responsibility of the person named as the holder of record of that ticket, should that ticket be selected as a winner. NCCH reserves the right to reject any entry form that is submitted with payment that does not constitute “good funds.” In addition, all defective or physically altered entry forms or tickets will be immediately disqualified. Prior to the drawing, NCCH will make a reasonable effort to notify the individual and/or entity whose entry form or ticket was rejected or disqualified for the aforementioned reasons. NCCH will utilize the information provided by the individual and/or entity at the time the purchase request was submitted. NCCH assumes no responsibility for lost, late, misdirected or non-delivered mail or fax messages, or any other failure to receive orders or tickets prior to the drawing deadline.

General Terms and Conditions

By purchasing tickets for this raffle, participants accept and agree to be bound by all the rules, limitations and restrictions set forth herein. In addition, participants accept and agree that their names and/or likenesses may be disclosed to and used by the news media or may otherwise be used by NCCH for publicity purposes. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W‐9 or the equivalent. Other rules and regulations may apply. By entering this raffle, each participant releases NCCH, its directors, officers, employees, volunteers and agents (“NCCH Releasees”) from any and all liability for injuries, losses or damages of any kind caused by participation in the raffle or winning the Cruise Certificate or resulting from acceptance, possession, use or misuse of the Cruise Certificate. In addition, the winner agrees to indemnify and hold NCCH Releasees harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of participating in the raffle or the winner’s acceptance or use of the prize.

The winner shall be required to sign and return to NCCH an indemnification and liability release within fourteen (14) days of being notified of winning the raffle or an alternative winner shall be selected at random from the remaining entries.
